CUTA Exchange Rules, Guidelines and Privacy Policy

Thank you for being part of CUTA Exchange – CUTA’s members-only online community. To ensure the best possible experience for all members, CUTA has established these rules and guidelines for participation in CUTA Exchange.

By joining this community and using CUTA Exchange, you agree that you have read and will abide by these rules and guidelines. This is a great mechanism to obtain the advice of your peers, benefit from your peers’ experience, and participate in ongoing members’ conversations. Any questions about the CUTA Exchange should be directed to communications@cutaactu.ca.

In order to preserve an environment that encourages both civil and fruitful dialogue, CUTA reserves the right to suspend or terminate membership in the CUTA Exchange of any person who violates these rules and guidelines.

The Rules

  1. Respect others. Focus on the content of posts and not on the person making the post. Extend the benefit of the doubt to newer members.  There’s no such thing as a stupid question.
  2. Respect the purpose of CUTA Exchange. Use CUTA Exchange to share successes, and challenges, provide constructive feedback, ask questions, and outline goals.
  3. Use caution when discussing products. Do not discuss products or services that you provide. If you have found a helpful product or service, share your experience with members in a respectful way.
  4. All postings are subject to applicable laws, including libel, antitrust, and intellectual property laws. Defamatory, abusive, profane, threatening, offensive or illegal content is strictly prohibited.
  5. Respect intellectual property. Only post content that you have personally created or have permission to use and have properly attributed to the content owner.
  6. Note any limitations of content posted.  When posting content in the CUTA Exchange collaborative forum, indicate if the content is not available for use or reproduction or requires permission from the content owner to use or reproduce.
  7. Post your content only to the most appropriate CUTA Exchange member communities. This helps to ensure all content receives the best response by eliminating “noise.”

Additional Discussion Group Rules

  1. State topic concisely and clearly in the subject line. This allows members to respond more appropriately to your posting and makes it easier for members to search the archives by topic.
  2. Do not send administrative messages, such as “remove me from the list,” to the group. Use the web interface to change your settings or to remove yourself from a list.

CUTA is not responsible for any content posted on CUTA Exchange. CUTA does not make any warranties or representations, express or implied, concerning the accuracy, reliability or completeness of any content posted on CUTA Exchange disclaims all warranties, including merchantability and fitness, regarding content posted on CUTA Exchange, whether posted by CUTA or any person.  In no event shall CUTA be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits arising out of or in connection with the use or performance of any content posted on CUTA Exchange.

Content posted on CUTA Exchange may contain links to other websites that are created and operated by third parties and do not imply the investigation or verification of the linked websites by CUTA. CUTA is not responsible, and CUTA makes no express or implied representations or warranties concerning the products, services and information found on the linked websites.

Posted Content

With respect to the posting of any content, the following will apply:

  1. No content posted will include any defamatory, abusive, profane, threatening, offensive, or illegal content.
  2. No content posted will contain any third-party intellectual property, including copyright, without the permission of the owner.
  3. By posting content, the person posting the content warrants and represents that they own the content or have permission to post the content and grant to, and does grant to, CUTA and the CUTA Exchange members the nonexclusive right and permission to use, display, and reproduce the content.
  4. No content posted should encourage or facilitate members to arrive at any agreement that either expressly or impliedly leads to price fixing, a boycott of another’s business, or other conduct intended to illegally restrict free trade. Any content that encourages or facilitates an agreement about the following subjects are prohibited: (i) prices; (ii) discounts; (iii) terms or conditions of sale; (iv) salaries; (v) profits or profit margins; (vi) cost data; (vii) market shares; (viii) sales territories or markets; (ix) allocation of customers or territories; or (x) selection, rejection, or termination of customers or suppliers.

CUTA occasionally monitors content posted but does not nor is CUTA obligated to, in any way, undertake editorial control of any posted content. In the event any posting in breach of these rules is brought to the attention of CUTA, CUTA may take any and all appropriate action.

CUTA reserves the right to terminate access to any person who breaches these rules.

Privacy Policy

CUTA is committed to respecting and protecting the privacy and confidentiality of personal information provided to and collected by CUTA. This Privacy Policy sets out what personal information is collected by CUTA, how the personal information is used and disclosed by CUTA, and how the personal information is handled by CUTA.

What personal information does CUTA collect?

“Personal information” means information about an identifiable individual, as more particularly defined in the Personal Information Protection and Electronic Documents Act (“PIPEDA”). CUTA collects personal information such as name, address, age, gender, e-mail address, telephone number, fax number, and credit card information.

For what does CUTA use personal information

CUTA collects personal information for the following purposes:

  • to provide member services
  • to administer CUTA organized or sponsored programs
  • to communicate with you
  • to process payments
  • to aggregate user analytics
  • to analyze business results

Limiting collection

The collection of personal information by CUTA is limited to that which is necessary for the purposes identified in PIPEDA and above.

Limiting use, disclosure and retention

CUTA will not use or disclose personal information for any purpose other than those for which it was collected, save and except with the consent of the individual or as permitted by law.  CUTA retains personal information only as long as necessary for the fulfillment of the purpose.

Keeping information secure

CUTA takes reasonable precautions to protect the personal information it collects. Access to this information is restricted to individuals whose job responsibilities require it for legitimate business purposes.

Consent

By providing personal information to CUTA, you consent to the use of the personal information by CUTA to provide you services. You may withdraw your consent at any time, subject to legal or contractual restrictions.

Accuracy

Personal information will be kept as accurate, complete, and up-to-date as is necessary for the purpose for which it is used.

Individual access

An individual may make a written request for access to their personal information in CUTA’s possession. An individual may be required to provide sufficient information to permit CUTA to properly provide an account of the existence, use, and disclosure of personal information.  The information provided will only be used for this purpose.

All requests will be handled in accordance with PIPEDA. CUTA may charge an individual for providing access to their information in accordance with PIPEDA. If an individual successfully demonstrates the inaccuracy or incompleteness of the personal information, CUTA will amend the personal information as required. Where appropriate, the amended personal information will be transmitted to third parties having access to the personal information at issue.

Challenging compliance

If an individual believes that CUTA is not complying with the principles set out in PIPEDA, the individual may contact CUTA who will investigate the individual’s concerns. If a complaint is found to be justified, CUTA will take appropriate measures, including, if necessary, amending its policies and practices.

Advertisements

CUTA may work with third-party advertising companies who may use cookies, web beacons, and data collected through CUTA’s services to customize advertisements to you respecting CUTA’s services, as well as on other websites or mobile applications in their networks beyond CUTA’s services. Among other things, these customized advertisements may advertise CUTA’s services and third-party products and services on websites or mobile applications not affiliated with CUTA. Such advertisements may contain cookies that allow monitoring of websites and mobile applications (including CUTA’s services) and your response to such advertisements.

Cookies or web beacons placed by these third-party advertising companies do not collect personal information, and the third-party advertising companies do not have access to or use your personal information. They may, however, anonymously track your usage across CUTA’s services and other websites or mobile applications in their networks. CUTA limits companies that place CUTA advertisements from using information for any purpose other than to assist CUTA in our advertising efforts.
